Understanding Employment Authorization Documents (EAD) and the New 540-Day Extension Rule

Introduction of the 540-Day Automatic Extension Rule

As of January 13, 2025, DHS has permanently extended the automatic renewal period for EADs from 180 days to 540 days. This adjustment is intended to help qualified applicants to avoid employment disruptions caused by processing delays.

This new rule applies to timely submitted EAD renewal applications that were either pending as of May 4, 2022, or filed on or after that date. By extending the validity period, DHS aims to provide applicants with greater job security while they await their renewed work authorization.

Eligibility Requirements for the 540-Day Extension

To qualify for this extended period, applicants must meet the following conditions:

  • Their pending Form I-765 renewal application must be accompanied by a Form I-797C receipt notice showing a “Received Date” that is prior to the expiration date of their current EAD.
  • The Form I-797C receipt notice must have a “Received Date” on or after May 4, 2022, or the renewal application must have been pending as of that date.
  • The renewal application must fall within an eligible EAD category.
  • You should apply in the same category/class as mentioned in your existing EAD. 

This policy shift ensures that qualified applicants can maintain their employment status without interruption while awaiting the approval of their renewed work authorization.
